E-SIGN CONSENT TO USE ELECTRONIC DOCUMENTS AND SIGNATURES

 

Fremont Bank is constantly striving to provide our clients with more convenience, control, and security to assist them in processing their transactions. This E-Sign Consent To Use Electronic Documents and Signatures ("E-Consent Statement") contains important information that we are required to give you before you consent to electronic documents and signatures relating to your Account(s). Please read this E-Consent Statement carefully and retain a copy for your records.

 

Consent to Electronic Signatures and Documents. Your consent to accept electronic documents and signatures means that once we present them to you and, if required, you click to accept them, the terms contained in those documents will apply to you and your Accounts with us. It also means that we may not mail you copies of documents that are provided electronically; however we may, at our discretion, make electronic documents available to you via a website or by e-mail, and may choose to send paper copies of documents to you even though we made or could have made them available to you electronically. "Account" means any Account(s) you have with Fremont Bank now, or in the future, including, but not limited to, a Deposit Account, Credit Account, Mortgage, Loan or Line of Credit.

 

Categories of Documents Covered By This E-Consent Statement. We are required by law to give you certain information "in writing". We may instead provide this information ("Covered Items") to you electronically if you: give us your consent to do so, provide us a designated e-mail address and satisfy the system requirements below. For purposes of this E-Consent Statement, these "Covered Items" may include disclosures, statements, notices, agreements, fee schedules, and other information and documentation.

 

Right to Withdraw Consent. You may withdraw your Consent at any time through your online account, or by notifying us by phone, in writing at the address below, or by sending instructions to us by e-mail. Upon withdrawal of your consent to use electronic documents and signatures, we will provide documents to you via U.S. Postal Service to your address of record. You agree to allow a reasonable time for us to resume providing disclosures and other information covered by this E-Consent Statement in written form.

 

Withdrawing your Consent will not affect the legal effectiveness, validity, or enforceability of any Account(s) or the Covered Items that were already provided before your withdrawal became effective. Withdrawing your Consent may, however, affect aspects of your Account related to your Consent, such as any discounted rates and fees, and even the availability of the Account. We will tell you about any affect on your Account during the withdrawal process.

 

Right to Paper Record. You may request copies of any Covered Items that was originally provided electronically (we may charge you a fee for providing some documents) by sending instructions to us by e-mail, in writing or by phone, at the address and phone numbers provided below. You must identify the specific record copies being requested.

Computer Hardware/Software Requirements. To access and retain the Covered Items, you must have a working e-mail address and a computer system or communications device with:

 

If a change in hardware or software requirements is needed in order for you to access or retain the Covered Items being provided to you in electronic form, we will alert you of any revised hardware or software requirements that your computer system or communications device will need to ensure ongoing access or retention.

 

Updated Contact Information. If you change your e-mail address, Internet Service Provider or other information needed to contact you electronically, you must provide us with updated information promptly. You can update information through Online Banking, by sending instructions in writing to us by e-mail or to the address above, or by calling us so that the Covered Items may be redirected to your new address.

 

Modification of E-Consent Statement. We reserve the right to modify these terms and conditions (E-Consent Statement) at our discretion. We will provide you with notice of such modification(s) electronically in a manner consistent with methods of providing Covered Items. If you do not agree to the E-Consent Statement as modified, you must notify us of your Withdrawal of Consent before its effective date. We will tell you the effective date in the notification, and change the effective date at the top of the new E-Consent Statement. Failure to withdraw your Consent, or take any other required action as stated in the notification before the effective date will confirm your continued agreement to the E-Consent Statement as modified. Modifications to these terms will only affect our respective rights and obligations from the effective date of the modification(s) and thereafter, and/or until a subsequent version of this E-Consent Statement takes effect, you withdraw your Consent, or the Account is terminated by either you or Fremont Bank.

 

Confirming Your Access and E-Sign Consent To Use Electronic Documents and Signatures. By providing your consent, you are also confirming that you have the hardware and software described above, that you are able to receive and review the electronic documents and that you have an active e-mail account. You understand that by giving us your Electronic Consent, you may no longer receive such Covered Items in paper form and you accept any consequence of not reviewing the Covered Items in a timely manner. Your Consent will remain in effect for your Account(s) until you withdrawal your Consent.

 

In this E-Consent Statement, "provide" means to deliver, make available, send, notify or similar term. We may provide the Covered Items electronically through, or through any combination of:

  1. your designated e-mail address,
  2. your Online Banking account or links provided through your online account,
  3. access via a website we designate in advance for such purposes, or
  4. files, including those in PDF format, downloaded from our website.

Consent to Electronic Signatures and Documents.

By clicking the "I Accept" box, you are providing electronic consent to the use of electronic documents and signatures. Until or unless you notify Fremont Bank as described above, you consent to receive through electronic means notices, disclosures, authorizations, acknowledgements, and other documents that are required to be provided or made available to you by Fremont Bank during the course of your relationship with Fremont Bank.
